These Terms of Service govern access to the Nolera store and purchases made through it.

By using our store or purchasing products, you agree to these Terms to the extent permitted by applicable law.

Nolera

“Nolera,” “we,” “our,” and “us” refer to the operator of the Nolera online store.

The store is hosted through Shopify.

Eligibility

You must have the legal capacity required in your jurisdiction to enter into a purchase transaction or act with the authorization of a parent, guardian, or other authorized person where required.

Accuracy of information

We attempt to present accurate product information, including descriptions, dimensions, photographs, colors, materials, package quantities, usage information, and specifications.

Minor variations may occur because of screen settings, manufacturing changes, supplier updates, production batches, packaging changes, or reasonable product revisions.

Product availability

Products may become unavailable without notice.

Submitting an order does not guarantee acceptance.

We may reject or cancel an order for legitimate reasons such as:

Lack of product availability; payment failure; suspected fraud; shipping restrictions; pricing or listing errors; supplier inability to fulfill; legal restrictions; or technical problems.

When we cancel a paid order and no substitute resolution is accepted, we will refund the applicable amount.

Third-party fulfillment

Nolera uses third-party suppliers, warehouses, logistics providers, and fulfillment partners, including Zendrop.

A third party's involvement in fulfillment does not change the fact that customers purchasing through the Nolera store should contact Nolera for customer service.

Pricing

Prices may change before an order is placed.

The applicable purchase price will generally be the amount presented at checkout, subject to legally permissible correction of obvious errors.

Applicable shipping fees and taxes will be disclosed at checkout.

Payment

You agree to provide accurate payment and billing information.

Payments may be processed by Shopify or other payment processors.

Products involving skincare, wellness, sleep, or personal care

Unless expressly stated otherwise, Nolera products are consumer beauty, skincare, self-care, or personal care products.

Our website does not provide medical diagnosis or medical treatment.

Customers should follow product instructions and warnings and discontinue use where appropriate if a product causes unexpected irritation, discomfort, or adverse effects.

For medical conditions, allergies, respiratory conditions, persistent skin concerns, pregnancy-related questions, medication interactions, or similar concerns, consult an appropriately qualified healthcare professional.

Importantly, this disclaimer does not authorize Nolera to make unsupported health claims. Advertising and product claims must still be truthful, non-misleading, and appropriately supported. The FTC specifically requires adequate substantiation for objective health-related claims.

No guaranteed individual results

Where a product's results naturally vary by person, no individual result is guaranteed unless expressly stated and properly supported.

Experiences described in customer reviews or testimonials do not necessarily represent results that every customer will experience.

Promotions

Discounts and promotions may include separate eligibility conditions and expiration dates.

We may cancel or correct promotions affected by technical errors, fraud, misuse, or unintended configuration, subject to applicable law.

Reviews and user content

Customers may submit reviews, photographs, feedback, or similar materials where functionality is available.

By submitting content, you represent that you have the right to provide it and that it is not knowingly false, unlawful, defamatory, infringing, fraudulent, or misleading.

Any license Nolera obtains to display user-submitted content will be limited by applicable law and the terms presented when the content is submitted.

Intellectual property

The Nolera name, original branding, original copy, graphics, site content, and other materials are owned by or licensed to Nolera unless otherwise stated.

They may not be reproduced or commercially exploited without authorization except where permitted by law.

Prohibited conduct

You may not use the store to:

commit fraud; make knowingly false claims; interfere with site operation or security; introduce malicious code; impersonate another person; access systems without authorization; infringe intellectual-property rights; manipulate promotions or payment systems; or engage in unlawful activity.

Fraud screening

Orders may be subject to fraud-prevention or payment verification measures.

We may decline or cancel transactions reasonably suspected of fraud or unauthorized payment activity, consistent with applicable law.

Third-party services

Our store may integrate with services operated by Shopify, payment providers, carriers, advertising platforms, fulfillment partners, or other parties.

Nolera is not responsible for independent third-party services beyond responsibilities that applicable law imposes on us.

Warranties

Products remain subject to warranties, guarantees, and legal protections that cannot lawfully be excluded.

To the maximum extent legally permitted, we do not create additional warranties except those expressly stated in writing.

Limitation of liability

To the fullest extent permitted by applicable law, Nolera will not be liable for indirect, incidental, special, punitive, exemplary, or consequential damages arising solely from circumstances for which such liability may lawfully be limited.

Nothing in these Terms excludes or limits liability, warranties, statutory remedies, or consumer rights that applicable law does not permit us to exclude or limit.

Indemnification

To the extent permitted by law, a user may be responsible for losses reasonably arising from that user's unlawful misuse of the website, fraudulent conduct, infringement of third-party rights, or material violation of these Terms.

Severability

If part of these Terms is held invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

No waiver

Failure by Nolera to enforce a provision on one occasion does not necessarily waive our ability to enforce it later.

Entire agreement

These Terms, together with applicable policies referenced on the store, constitute the agreement governing use of the Nolera store except where additional terms are expressly presented.

Governing law

The final governing-law and venue provision should identify the jurisdiction associated with your actual business entity or principal place of business, while preserving any mandatory consumer protections applicable to the customer.

Do not put a random state here solely because it appears favorable.

Changes

We may update these Terms from time to time.

Updates apply prospectively except where applicable law permits otherwise.
